Mobile phone numbers are collected solely for the purpose of providing non-marketing, informational SMS service alert notifications, as further described below. DataVox may share this information with third-party vendors and manufacturers for marketing or support purposes. We do not share mobile phone numbers collected for SMS service alerts with third parties for marketing or targeted advertising.

We disclose personal data to third-party processors solely to enable service delivery, customer support, and SMS message transmission. We require processors to use the data only for the instructed purposes, implement appropriate security, and not to sell the data or use it for targeted advertising. We do not sell personal data or engage in targeted advertising using mobile numbers collected for SMS alerts. SMS/Text Message Service Alert Notifications

Program Description

DataVox offers an SMS service alert notification program that sends automated text messages to enrolled customers regarding service outages, scheduled maintenance windows, and service restoration updates. These messages are informational only and are not used for marketing, advertising, or promotional purposes.

Consent and Enrollment

By providing your mobile phone number and opting in to the SMS service alert program, you consent to receive automated text messages from DataVox at the mobile number you provide. Consent is not a condition of purchasing any goods or services. You may enroll by responding to a DataVox enrollment communication or through your service agreement. Your consent is limited to non-marketing, informational service alerts related to outages, maintenance, and restoration; it does not include consent for marketing or promotional texts.

Message Frequency

Message frequency varies based on service events. You will only receive messages related to outages, maintenance, or restoration affecting your services.

Opt-Out

You may opt out of SMS service alerts at any time by replying STOP to any message. Upon receipt of your STOP request, you will receive a single confirmation message, and no further SMS messages will be sent. To re-enroll, reply START. Sender Identification and Support

Message and data rates may apply. DataVox is not responsible for any charges incurred from your mobile carrier for receiving text messages.

Data Use

Mobile phone numbers collected for the SMS service alert program will be used solely for the purpose of delivering service-related notifications. DataVox will not sell, rent, or share your mobile phone number with third parties for marketing purposes. Mobile numbers are transmitted to Microsoft Azure Communication Services solely for the purpose of SMS delivery. We maintain records of consent, enrollment, and opt-out requests for SMS alerts and periodically audit our consent and opt-out logs to confirm compliance with our policies and applicable law.

Data Retention for SMS Alerts

We retain mobile phone numbers used for SMS service alerts and related consent/opt-out logs for 12 months after the later of (a) your last message activity or (b) termination of your enrollment, unless a longer retention period is required to comply with legal obligations or to resolve disputes. Thereafter, mobile numbers are deleted or de-identified consistent with our retention schedule.

 

Use of Web Beacons or GIF files

DataVox web pages may contain electronic images known as web beacons – sometimes also called single-pixel gifs – that allow DataVox to count users who have visited those pages and to deliver co-branded services. DataVox may include web beacons in promotional e-mail messages or newsletters in order to determine whether messages have been opened and acted upon.

Some of these Web beacons may be placed by third-party service providers to help determine the effectiveness of our advertising campaigns or email communications. These web beacons may be used by these service providers to place a persistent cookie on your computer. This allows the service provider to recognize your computer each time you visit certain pages or emails and compile anonymous information in relation to those page views, which in turn enables our service providers and us to learn which advertisements and emails bring you to our website and how you use the site.

 

Your Access to and Control Over Information

Security

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. The computers/servers in which we store personally identifiable information are kept in a secure environment. For SMS data, we implement administrative, technical, and physical safeguards, including access controls, transmission encryption, least-privilege access, and periodic security reviews. We also monitor our messaging program for spoofing and unauthorized use and take steps to prevent and remediate such activity. We do not use mobile numbers collected for SMS service alerts for marketing or targeted advertising.

Unsubscribe

Email legalnotices@datavox.net if you would like to unsubscribe from all future communications. To opt out of SMS service alert notifications, reply STOP to any text message from DataVox; you will receive a single confirmation message and no further SMS messages will be sent. To re-enroll, reply START. For help, reply HELP or contact legalnotices@datavox.net or 713-881-7107. We process unsubscribe and STOP requests promptly and maintain records of your preferences.

 

Updates to Privacy Policy

DataVox reserves the right to update or modify this privacy policy at any time. Any changes to this privacy policy will be posted to this website. You should contact us immediately at legalnotices@datavox.net or call 713-881-7107 if you feel that we are not abiding by this privacy policy. If after contacting us, you do not feel the problem was resolved and wish to make a complaint, please contact the Texas Attorney General.

 

Recordkeeping and Audits

We maintain records sufficient to demonstrate consent to receive SMS service alerts, message content parameters, and opt-out requests, including timestamps and message originator information, for the retention period specified above. We conduct periodic reviews and audits of our SMS consent and opt-out processes and third-party processor compliance to confirm adherence to this policy and applicable law.
